ONE WORLD PROPERTIES will actively search for a property for the Client and actively feedback information on such findings as soon as the Client signs and returns these Conditions of Business and the registration fee has been paid in full.
Finders Service
We will undertake, upon acceptance of your instructions, to work with you to find the most suitable property possible for you to purchase, in accordance to your brief.
Fees
Our registration fee is £495.00 (deductible from the success fee) and our success fee is 1.5% of the purchase price for any property you exchange contracts to purchase. For rentals, our registration fee is £195.00 (deductible from our success fee) and our success fee is one month’s rent. No VAT is currently charged.
The registration fee for the 6-month period (purchase) or 1-month period (rental) will be refunded to the client once we have received the full payment for the success fee. Failure to find a suitable property within the 6 month, or 1-month term does not warrant the return of the registration fee unless ONE WORLD PROPERTIES agrees to do so.
For the purpose of this agreement, we shall be deemed to have introduced a property to you if either you have received the particulars of a property from us, directly or indirectly, or from any of the firms of estate agents with whom we have registered on your behalf, or through agents or individuals whom you have instructed us to negotiate with on your behalf.
For the purpose of this agreement, you will be deemed to exchange contracts to purchase a property if:
a) You, or any close relation, or any person with the aid of any funds provided by any such persons, acquires or agrees to acquire, or any body corporate or trust in which any of those persons has an interest (directly or indirectly) acquires or agrees to acquire, any legal or beneficial or other interest in any freehold or leasehold property, or agrees to occupy a property.
b) A Third Party acquires or agrees to acquire any legal or beneficial or other interest in any freehold or leasehold property, or agrees to occupy a property and, within one year you occupy that property either together with or independently of that Third Party (including temporary occupation).
Duration
The search term will last for 6 months from the date we receive a signed copy of these Conditions of Business. After the 6 months elapse, on agreement with ONE WORLD PROPERTIES if the Client wishes to do so, the Client may renew registration for a further 6 months.
Either party are able to terminate the agreement at any time by giving one months notice in writing unless the 6 month term naturally expires within the next month.
The agreement will be terminated forthwith if the Client is deemed to be not abiding by these terms. ONE WORLD PROPERIES will refund a fair and reasonable amount of the registration fee paid if this happens.
Payment
Payment of fees (other than the Registration Fees) shall be made in full on exchange of contracts for the purchase or rent of a property and be shall be forwarded directly to us via your Solicitor.
We reserve the right to charge interest on any late payments at a rate of 4% per annum above base rate of Barclays PLC.
Liability
Details of properties, valuations, reports and other information provided by us are prepared and put forward in good faith and are solely for your guidance. They do not form any part of any contract relating to the purchase or letting of any property.
All clients must satisfy themselves as to the correctness and accuracy of any details provided by us in line with the above paragraph.
ONE WORLD PROPERTIES do not accept any liability for the views of, or contents of any report prepared by, any Third Party in relation to any property.
In the event that the Client suffers loss as a result of negligence or otherwise, the liability of ONE WORLD PROPERTIES will be limited to the lesser of the purchase price of the property being purchased or an amount not exceeding £500,000 in respect of any individual claim or aggregate of claims relating to the same property.
ONE WORLD PROPERTIES do not accept any liability arising from any indirect of consequential losses in relation to any property.
We strongly recommend that all clients take appropriate legal and other relative advice and to use the services of solicitors, surveyors, values and other specialists. The service provided by us is not intended as a substitute to such advice and accordingly no liability is accepted for any defects in legal title or in the fabric and structure of any property.
ONE WORLD PROPERTIES is not a financial advisor and not regulated by the FSA. The services we provide is for your assistance but not for advise purposes.
General
The supply of the services by us is subject to the terms and conditions set out in this agreement and, unless otherwise agreed in writing by us, these conditions shall prevail over any other terms and conditions and shall comprise the whole agreement between you and us.
If ONE WORLD PROPERTIES have to change these Terms, we will try to publicize the fact, but it is the Client’s responsibility to ensure that the Client has the latest version of the Terms.
No relaxation, delay or indulgence by us in exercising rights or enforcing these terms and conditions or the granting of time by us for the remedy of any breach shall operate as a waiver of any subsequent or continuing breach.
If at any time any of these conditions are found to be unreasonable, unlawful or invalid then the validity of the remaining conditions or parts thereof shall not in any way be affected or impaired and shall be in force as if the unreasonable, unlawful or invalid part had not been included.
For the avoidance of doubt, nothing in the Agreement shall confer on any third party any benefit or the right to enforce any term of this Agreement.
The laws of England & Wales govern this Agreement, and you agree to submit to the exclusive jurisdiction of the courts of England & Wales.
Data Protection
ONE WORLD PROPERTIES may use my personal information provided during the period of this Agreement and may disclose my information to vendors and other intermediaries or agents as required in order to provide a property search and acquisition service. You have the right to request a copy of your information and to correct any inadequacies in the data.
Glossary
References to “the Client” are to the individual, firm or company from who ONE WORLD PROPERTIES receive instructions.
“These Terms” means the terms printed on this document (or any replacement that ONE WORLD PROPERTIES issue).
“Third Party” means persons from who ONE WORLD PROPERTIES may source other products or services, or persons with whom the Client has instructed us to work with.
